Orb Terms of Service

1. Acceptance
These Terms of Service govern use of the Orb mobile application and related materials provided by Jnana Lab.
By downloading, accessing, or using Orb, the user agrees to these Terms. If the user does not agree, they should not use the app.
2. About Orb
Orb is a meditation, breathwork, timer, and sleep-support app centered around a living animated orb. It offers breathing guidance, still timers, sleep sessions, sound fields, bells, haptics, customization, and private practice history.
Orb is designed for general wellness and reflection.
3. Not Medical Advice
Orb does not provide medical advice, diagnosis, treatment, therapy, emergency support, or crisis services.
Users should not rely on Orb as a substitute for professional medical or mental health care. Anyone experiencing a medical emergency, mental health crisis, or risk of harm should contact local emergency services or a qualified professional immediately.
Breathwork may not be appropriate for everyone. Users are responsible for choosing practices that feel safe for their body and circumstances.
4. License To Use Orb
Subject to these Terms and any applicable App Store terms, Jnana Lab grants the user a personal, limited, non-exclusive, non-transferable license to use Orb on devices the user owns or controls.
The user may not:
- Copy, modify, redistribute, sell, lease, sublicense, or commercially exploit Orb.
- Reverse engineer, decompile, or attempt to extract Orb's source code except where applicable law allows it.
- Use Orb in a way that violates law or infringes another person's rights.
- Interfere with Orb's operation, security, or availability.
5. Apple App Store Terms
If Orb is downloaded through the Apple App Store, use of Orb is also subject to Apple's applicable App Store terms, including Apple's standard end user license agreement unless Orb provides a custom EULA through App Store Connect.
If there is a conflict between these Terms and Apple's required terms for App Store distribution, Apple's required terms may apply to the extent of the conflict.
6. User Data And Privacy
Orb's privacy practices are described in the Orb Privacy Policy.
Orb is designed to work without an account and to store core practice data locally on device. Users are responsible for exported files, device backups, and any information they choose to share outside the app.
7. User Content And Reflections
Orb may allow users to save custom paths, preferences, optional names, and post-session reflections. The user remains responsible for the content they choose to enter or export.
Jnana Lab does not claim ownership of the user's personal practice history or reflections.
8. Purchases And Paid Features
Orb currently does not include subscriptions or in-app purchases. If paid features, subscriptions, or other purchases are added in the future, purchase terms will be shown before purchase and will be handled according to the applicable App Store rules.
9. Intellectual Property
Orb, including its design, visuals, animations, sounds, code, text, logo, name, and related materials, is owned by Jnana Lab or its licensors and is protected by intellectual property laws.
The user may not use the Orb name, app visuals, screenshots, or brand materials for commercial purposes without permission, except as allowed by law.
10. Availability And Changes
Orb may change over time. Features may be added, changed, suspended, or removed. The app may not always be available, error-free, or compatible with every device or operating system version.
Jnana Lab may update the app to improve quality, privacy, safety, compatibility, or user experience.
11. Third-Party Services
Orb may use Apple system features such as Siri, Shortcuts, Spotlight, haptics, local notifications if added in the future, device audio, and App Store distribution. These services are provided by Apple and may be subject to Apple's own terms and policies.
Orb does not currently depend on third-party analytics, advertising, or account services.
12. Disclaimer Of Warranties
Orb is provided "as is" and "as available" to the maximum extent permitted by law. Jnana Lab does not promise that Orb will meet every user's needs, produce any particular wellness result, or be uninterrupted, secure, or error-free.
Some jurisdictions do not allow certain disclaimers, so some parts of this section may not apply to every user.
13. Limitation Of Liability
To the maximum extent permitted by law, Jnana Lab will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, device issues, emotional distress, personal injury, or other damages arising from use of or inability to use Orb.
Some jurisdictions do not allow certain liability limits, so some parts of this section may not apply to every user.
14. Termination
The user may stop using Orb at any time and may delete the app from their device.
Jnana Lab may suspend or terminate access to Orb if the user violates these Terms or if continued access would create legal, security, or operational risk.
15. Governing Law
These Terms are governed by the laws of the Argentine Republic, excluding conflict of law rules.
Any dispute arising from these Terms or from use of Orb will be submitted to the competent courts of the Argentine Republic.
16. Changes To These Terms
These Terms may be updated as Orb changes. The updated version will be posted with a new "Last updated" date. Continued use of Orb after changes means the user accepts the updated Terms.
